I consider this list directly responsible for helping me keep my home. Your
excellent advice and explanations helped me understand what the bank was
saying. One wonderful list member in particular steered me to the
Federally-funded mortgage assistance program called PHASES. Today PHASES cut
me a check to pay the entire amount of back mortgage arrears. They
negotiated with my mortgage company and made sure I was in the information
loop at all times. There were some definite hoops to jump through and a lot
of paperwork to complete. I also had to make financial commitments to always
pay the mortgage on time, adhere to a budget and check in with them every
three months for the next year. If you know of anyone three months or less
behind on their mortgage please feel free to direct them to my off-list
email address and I'd be happy to give them the details of what they'll have

In a time when so much is being written about the scams being perpetrated

Did you get an agreement signed by an entity that has authority to sign
for whoever owns your loan?
Did you avoid a 1099?
Did you gain a current appraisal to make sure you are not underwater?
Did you gain access to a lawyer to evaluate your potential consumer
claims relating to the origination and servicing of your loan?

Alan - back when I was out in the world (before retirement) a large part of
my work involved finding information for non-profit organizations as well as
individuals in need. It has really bothered me that Washington keeps talking
about money to help people in foreclosure without telling those same people
where to find it. So I went on a treasure hunt so to speak. Someone on this
list steered me to one of them but there are a large number of national
non-profits administering some of the bailout money as we speak. Below is
one of the press releases from MMI/PHASES website which stands for
"Preserving Homeownership and Savings Education Strategy (PHASES)" You've
probably heard of the other programs they work in conjunction with, HOPE and
Neighborhood Works. I started with my local Neighborhood Works program and
then moved to a lengthy conference call with HOPE. From there I provided
lots of paperwork, completed their application and took the online credit
counseling program which was actually pretty impressive. The $7,500 paid to
catch up my mortgage came at the end of a long work filled rainbow.
Regarding April's questions, remember I did not get a new mortgage but
received funding to catch up the existing mortgage. Anything the money
helped pay for like to reappraisal belongs to me since having to pay for it
is part of the final transaction. SK.

Is the funds a straight out grant or administered like a partial claim or
rescue loan fund?
I along with our local state task force was unaware of the PHASES program.
This is good information to provide to our foreclosure program participants.

It's a straight out grant. I had to agree to keep the mortgage payments
current, take their online finance training and check in quarterly about how
things are going for us financially. In our case we're saving a small amount
of money each month to prove to PHASES that we're serious about getting back
on our feet. The toughest part of obtaining the foreclosure grant is meeting
the required debt to income ratio. We had to show, through submitting our
financial documents, that we have reached the point where our income was
larger than our debts. It makes sense if you consider it. I recently read
that the principal problem with foreclosure programs is that, without
refinancing and thereby lowering the amount of the monthly mortgage payment,
without at least a little discretionary income people still couldn't meet
the original mortgage payment that got them in trouble in the first place.
The bottom line is that when you get into financial trouble what you really
need is plain old cash and after 25+ years in the grant world it's a pretty
rare program that offers that. I guess it's a sign of the times that cash
programs are finally popping up.

This particular program is not designed for that but other programs such as
NeighborWorks are. It's an either or thing. Either a mandated non-profit can
negotiate with your mortgage company for a lower interest rate or you can
apply for a grant to catch up your back mortgage payments. We knew we could
handle the payments if only we could get caught up. Again, one of the
problems becomes that you're credit has most likely been destroyed because
you fell behind on everything. You need at least a little bit of decent
credit to get a refinance. NeighborWorks was willing to negotiate on our
behalf with HSBC but we wanted that to be a last resort. Hope this makes
sense. I think the best advice I can give is recognizing that every
situation is going to be unique. We might have made different decisions if
we'd had young children or we might have made different decisions if I
wasn't due to get my pension started or if my disability application hadn't
been approved. The most important thing, IMHO, is that there are options
available to the public that they are currently unaware of. With a listserv
the size of this one I suspect the public won't be unaware for long.

PHASES began with a large Federal grant I believe. It doesn't matter who the
applicant's lender is. Check out this news release. It's very specific about
funding streams and would be useful to forward to your political

Is this available to individuals with mortgages from HSBC only or to
individuals with mortgages from any lender? I understand the grant comes
from HSBC and you mentioned your mortgage was with HSBC so I wanted to
clarify who this is available to, as we pursue our state representatives to
get this program brought to our state.
